| What is a Temporary License of Occupation? |
| A Temporary License of Occupation gives the legal conditional authority for a business, individual, or group to utilize public property in order to carry out specific activities. |
| What Activities Need a Temporary License of Occupation? |
| In this case, a license is required for outdoor restaurant and bar patios (Sidewalk Cafes), tables, chairs, display racks, and merchandise (Merchant Encroachments), Mobile Vendors (chip trucks, hot dog stands and souvenir vans), Non Profit Vendors (raffle stands, charity barbeques), Street Performers, Community Events (faires and parades) and Mobile Vendor Associations (Farmers Markets) which require the use of public space such as sidewalks, boulevards, rights of way, parks, and parking spaces. Definitions of these licensees and activities are provided in this application. |
| Why Have a Temporary License of Occupation? |
| Sidewalks, boulevards, rights of way, parks, and street parking (Public Spaces) have been built by and for the public through taxation. This gives the general public the right of free access to and ownership of these amenities. Business and other organized uses must therefore come with terms and conditions, which may include payment for use of these amenities for business or other purposes. |
| What is the Fee? |
| Costs are calculated based upon the type, length, location, and scope of use and are included in the policy. |
| What are the Other Conditions of the Temporary License of Occupation? |
| Conditions include the requirements for insurance, appropriate and aesthetic construction, size, and maintenance obligations, among others. Review the attached policy to become familiar with these conditions and how they apply. |
| How Long is the Approval Process? |
| Approvals can be made at the staff level, helping to speed the process. That said, the more complex the application, the longer the process will be. Generally you should allow for between one and four weeks. Provided there are no changes, problems, or complaints, a License can be renewed annually over a three year term. |
| How do I Apply? |
| Fill out the the application, include other relevant documentation as required by the type of activity you are applying to carry out and submit to the Town of Golden. Staff may require an appointment to discuss your application in person. Should approval in principle be given, you will need to provide proof of liabiltiy insurance and other third party approvals if required. |

| No approvals will be granted to any business not holding a valid and current Town of Golden Business License or having outstanding accounts with the Town of Golden. | ||||||

| Sidewalks, boulevards, rights of way, parks, streets, and street parking spaces owned or leased by the Town of Golden. |
| Sidewalk Cafe (Outdoor Patio, Street Patio/Deck) |
| A directly adjacent spatial accessory use to a restaurant or licensed establishment located on the main floor of a building occupying portions of Public Space, typically for the purpose of serving food and beverages in an outdoor environment to seated patrons, and consisting of at least 3 tables with associated seating. |
| Merchant Encroachment (Table or Display Racks, Merchandise, Seating) |
| A directly adjacent spatial accessory use to a restaurant, licensed establishment, or retail establishment located on the main floor of a building, occupying portions of Public Space, for the purpose of serving food and beverages, providing a space for their consumption, or displaying merchandise in an outdoor setting, with seating for no more than 4 individuals; |
| Community Event (Fairs, Parades, Outdoor Concerts) |
| A mass participatory event either centrally located or mobile, free of charge to the public for the purposes of entertainment or education, and organized by a non-profit entity other than a Mobile Vendor Association which may include Mobile Vendors, Non-Profit Vendors, Street Performers and Mobile Vendor Associations. |
| Mobile Vendor (Chip Trucks, Concession Stands, Merchandise Vehicles) |
| An independently operated vehicle, structure, or mobile food vending apparatus occupying Public Space, typically for the purpose of providing food and beverages, retail products, or services for commercial sale by a business entity, in an outdoor setting to either passers-by or seated patrons. |
| Non Profit Vendor (Raffle Stands, Charity BBQ's) |
| An independently operated vehicle, structure, or mobile food vending apparatus occupying Public Space, typically to provide food and beverages, retail products, information or services for sale or free consumption by a non profit entity, citizen association or service club, in an outdoor setting to either passers-by or seated patrons for the purposes of fund raising or addressing public awareness of a general or specific issue. |
| Street Performer (Buskers, Acrobats, Bands, Artists) |
| An individual or group utilizing Public Space for the purpose of public exhibition of, and on site or third party remuneration for, artistic expression. |
| Mobile Vendor Association (Farmers Markets, Business Associations) |
| A collection of independent mobile vendors established through organized association serving food, beverages, services, or specialized retail products in an outdoor setting to either passers-by or seated patrons by utilizing either vehicles, independent food preparation or retail vending apparatus', simple structures or mobile shelters and occupying portions of Public Space. |
